Raleigh: Pay If You’re Too Noisy, No Front Yard Parking

The Raleigh City Council voted 6-1 Tuesday fine those who make too much noise. The City is also considering a limit on front yard parking.

Under the newly amended noise ordinance, Raleigh police officers will be able to issue civil citations for party and noise violations.

Penalties would be $100 for the first violation and $300 for each subsequent violation within 12 months of a previous violation.

If a third civil penalty is issued against the same property within a 24-month period, the landlord will be given a probationary rental occupancy permit and required to pay $500 a year for two years and attend rental management classes.

The citations can be appealed to an independent arbitrator.

The change takes effect on July 1.

On the front yard parking, the council will hold a public hearing July 21 at 6:30 p.m. in the city council chamber at the Avery C. Upchurch Government Complex, located at 222 W. Hargett St.

Citizens will be given an opportunity to comment on the front-yard parking proposal at the public hearing.

The proposal would:

• Limit front-yard parking to the driveway (linear or circular) and to an additional 330 square feet (approximately the size of two parking spaces) or 40 percent of the front-yard area, whichever is less;
• Require landscaping around parking areas in some cases; and,
• Require front-yard parking areas for single-family homes constructed after Oct. 1, 2009 to be constructed of permanent, non-erodible surface treatment masonry, concrete or asphalt; or constructed with crushed stone or crush-and-run with a minimum depth of 4 inches and permanent borders.

The new front-yard parking regulations would take effect on Oct. 1.
